I'm sure everyone has heard the term FDR Requirements by now. But what do you actually have to do to meet these requirements? Well, these requirements pertain to agents that have non-agent employees (not licensed with an MA/PDP Carrier). So, if you employ or contract anyone who isn't appointed with an MA Carrier and they have access to or handle Medicare Advantage/Part D business in any way, then you have to complete the following requirements for each of those individuals.
Deliver the Medicare Parts C & D Fraud, Waste, and Abuse and General Compliance Training to all Non-Agent Employees and/or Contractors.
  • Complete within 90 days of hire and annually thereafter.
  • As of Jan. 1, 2016, you must use the CMS version of this training.
  • Follow the link above to access it. Go to the downloads section and click on the "Medicare Parts C and D Fraud, Waste, and Abuse Training and Medicare Parts C and D General Compliance Training" link.
Distribute a Code of Conduct and Compliance Policies to all
Non-Agent Employees/Contractors.

  • Complete within 90 days of hire and annually thereafter
  • Can distribute each carriers Code of Conduct or draft your own equivalent Code of Conduct that meets the standards of each carrier.
  • We have templates available for you to use that meets all requirements. Just contact us for more information.
Check each Non-Agent Employee/Contractor against the OIG
and GSA excluded parties' lists.

  • Complete prior to hire and monthly thereafter.
  • See the compliance page of our website for further instructions on how to complete this requirement.
  • If any of your employees are on either of these lists, they need to be removed from all duties corresponding with Medicare Advantage/Part D.
Retain documentation of completion of each requirement for
at least 10 years
  • Attestation Pages
  • Certificates of Completion
  • Screen shots
  • Etc.
